What Buying Land in Ghana Costs Beyond the Price

When you buy land in Ghana, the price of the land is the largest cost. The rest are smaller charges for searches, valuation, stamp duty, registration and legal work, plus permits if you build. Knowing who sets each one, and when you meet it, makes the purchase easier to plan. This article goes through them in order. Each body sets its own fees and revises them from time to time, so the current figure is the one it publishes.

Before you pay: searches and legal fees

Many buyers start with an official search, which shows what is recorded against the land. Under the Land Act, 2020, the Lands Commission issues the search report within fourteen days of the fee being paid. Our article on how to verify a land's registration status in Ghana explains what a search can and cannot tell you.

Legal fees begin here too. The document that transfers land to you is called a conveyance. A sale document, a lease and a sublease are all conveyances, and under the Land Act only a lawyer may prepare one.

Making it official: stamp duty and registration

Stamp duty is a tax charged on a document under the Stamp Duty Act, 2005. Stamping is the step where the duty is assessed and paid and the document is marked to show it. The Lands Commission carries out the valuations used to assess the duty. A land document generally has to be stamped before it can be registered, and the Act sets a short time limit for stamping after signing. For a document signed outside Ghana, that time runs from the day the document arrives in Ghana. Your lawyer will know the current rate and deadline.

Registration at the Lands Commission carries its own fee. The Commission must publish its fees on its website and at its offices, and its fees and charges page is the place to look. If you are unsure which kind of registration applies to your land, land title and deed registration in Ghana explains the difference.

If you plan to build: permits and fees

A development permit from your local assembly is needed before any building work. Depending on where the land is, that is a District, Municipal or Metropolitan Assembly, called the Assembly below. The permit covers planning and building permission together, under the Land Use and Spatial Planning Act, 2016. The Assembly charges a permit fee and may also charge a development charge, where its own fee-fixing resolution provides for one. These differ from one Assembly to another.

Water and electricity connections are charged by the providers. The cost of designing and building a home is a separate subject and is not covered here.

After you own the land: rates, rent and estate charges

Property rates are assessed on a rating valuation of the land. If the land is leasehold, the lease says what annual payment is due and how it can change. Our article on Ghana's 50-year lease cap explains how leases run and renew.

Charges for shared areas apply only where the land is inside a gated community run by a management company. In such a community, owners may be charged a service fee, a sinking fund contribution or both, as that community's rules set out. Ask what each charge covers and how it is set.

Forest Hill is planned as a managed, gated estate. Owners pay a monthly service fee for maintenance, an annual sinking fund contribution, and an annual lease payment. The sinking fund is a reserve built up each year for major work on the common areas and for their insurance. Residential and commercial plots are charged differently.

How to find the current figures

Each of these charges is set by a different body. The Lands Commission lists its fees for services such as searches and registration on its fees and charges page. Its online services portal has a bill calculator for estimating the cost of land services in advance, and lets account holders track applications and pay fees. Each Assembly sets its own charges through a fee-fixing resolution. Amounts are left out because they change, so this article stays accurate when they do. Your lawyer can give you a written breakdown of these costs before you pay anything.

A checklist to take to your lawyer

Ask your lawyer to confirm each of these before you pay:

  • Official search

  • Legal fees

  • Stamp duty

  • Registration fee

  • Development permit fee and any development charge, if you plan to build

  • Water and electricity connections

  • Property rates

  • Annual lease payment, if the land is leasehold

  • Service fee and sinking fund contribution, if the land is in a managed community

If you are looking at a plot at Forest Hill, the Sale and Purchase Agreement sets out which of these costs the buyer pays and when. You are welcome to have your own lawyer go through it with you, and our plots page sets out the price, the plot size and the buying steps.

Where this comes from
